Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Birthday Remindermobile application ("the App"). By downloading or using the App you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Birthday Reminder you confirm that you are at least 13 years old (or the minimum age required in your jurisdiction) and that you agree to these Terms. If you do not agree, please do not use the App.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device(s) for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or its source code.
• Reverse engineer, decompile, or disassemble the App.
• Sublicense, sell, rent, or transfer your rights to the App.
• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to extract, scrape, or collect data from other users (note: there are no other users — all data is local to your device).

3. User Content

All content you enter into the App (names, birthdays, notes, photos, gift ideas) is stored solely on your device. You retain full ownership of your content. We do not access, store, or claim any rights over your content.

You are solely responsible for ensuring that the content you enter does not violate any third-party rights, including privacy rights of individuals whose information you store.

4. Device Permissions

The App may request access to device features (contacts, camera, photo library, notifications, calendar). These requests are optional. You may grant or revoke permissions at any time through your device settings. Revoking a permission may limit related functionality within the App.

5. Third-Party Platforms

The App is distributed through the Apple App Store and Google Play Store. Your use of those platforms is governed by Apple's and Google's respective Terms of Service. We are not responsible for those platforms.

6. Updates & Changes to the App

We may release updates to the App from time to time to add features, fix bugs, or address security issues. We reserve the right to modify or discontinue the App (or any part of it) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

In particular, we do not guarantee that reminders and notifications will be delivered on time. Notification delivery depends on your device settings, operating-system restrictions (e.g., battery optimization, Do Not Disturb), and factors outside our control. You remain responsible for remembering important dates.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising out of these Terms or the App shall not exceed the amount you paid for the App (which is zero, as the App is currently free).

9. Indemnification

You agree to indemnify and hold harmless Birthday Reminder and its developers, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of competent jurisdiction where the developer is located.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the revised Terms.
